Terms of Use
These Terms of Use govern the use of the MINK mobile applications and the theminkapp.com website. By using the Platform you accept these Terms. If you do not agree, do not use the Platform.

Governing law: Legislation of the Republic of Azerbaijan
1. Definitions
- Platform — the MINK apps and theminkapp.com;
- User — an individual using the Platform;
- Business user — a venue owner or staff member using Mink Business;
- Venue — a restaurant, café or food-service establishment registered on the Platform;
- Maira — MINK’s AI assistant;
- NamNam — an in-platform bonus unit;
- Voice message — a voice recording sent within chat;
- Subscription — a paid plan for business users (Business/Premium).
2. Use of the Platform
2.1 Registration
- You must be over 13 to use the Platform;
- Users under 18 must use paid services with the consent of a parent or legal guardian;
- Accurate and complete information must be provided at registration;
- Account security and protection of credentials are the user’s responsibility;
- An individual may have only one account.
2.2 Prohibited conduct
- Registering with false data or creating an account on behalf of another person;
- Fake reviews and rating manipulation;
- Spam, insults, threats, discrimination — in text or voice messages;
- Unauthorised interference with the Platform’s technical infrastructure;
- Abuse of the reservation or payment system.
3. Reservation service
3.1 Creating reservations
- Reservations are created through the app;
- A unique confirmation code may be issued for each reservation;
- Venues may set their own reservation rules, guest limits and working hours.
3.2 Deposit and payment
- Some venues may require a deposit or prepayment; the amount is shown at reservation time;
- Payments are processed via a third-party payment provider (Epoint);
- The Platform does not store the full card number or CVV;
- Deposit and refund rules apply according to the relevant venue’s policy.
3.3 Cancellation and no-show
- Cancellation rules are set by each venue;
- No-show and refund matters are resolved according to the rules shown in the app;

4. NamNam system
- NamNam is not real money but an in-platform bonus unit;
- It can be used only within the Platform;
- It cannot be cashed out, transferred to another person or converted to money;
- MINK may change NamNam earning and spending rules with prior notice.
5. Reviews and user content
- Reviews must be based on real experience;
- Spam, insulting, misleading and unlawful content (text, photo or voice) may be removed;
- You retain rights to the content you upload; however, you grant MINK a non-exclusive licence to display it on the Platform.
6. AI assistant Maira
- Maira is an advisory AI assistant; its responses are not a guarantee;
- Do not give Maira your card number, password or other sensitive data;
- Chat data may be transmitted to AI providers to generate responses.
7. Business users and subscriptions
- The accuracy of venue profile, menu, prices, working hours and legal data is the business user’s responsibility;
- Business features require a paid subscription (Business/Premium); plan scope is shown in the app;
- Recurring payment: the subscription may operate as a recurring payment via Epoint — after a one-time consent it may be charged automatically each period;
- Cancellation: you may cancel the subscription at any time; after cancellation there are no further charges and access continues until the end of the current paid period;
- Refunds: no money is refunded on cancellation (standard SaaS). Refunds are issued manually by MINK only in cases such as mistaken payment, duplicate charge or billing error, and also cancel the relevant subscription;
- MINK may suspend or deactivate venues that do not comply with the rules;
- Commission and special terms may be set by a separate agreement.
8. Account suspension and deletion
Accounts that violate these Terms may be temporarily suspended or permanently blocked. A user may delete their account at any time from within the app (Profile → Delete account); some records may be retained for the period required by law due to legal obligations.
9. Intellectual property
The MINK name, logo, design, software code and content are MINK’s intellectual property. Unauthorised copying, distribution and modification are prohibited.
10. Limitation of liability
MINK is an intermediary platform between users and venues. The venue is responsible for the quality of the service it provides and the accuracy of the information it submits. No full guarantee is given for technical interruptions, third-party services or AI responses. To the maximum extent permitted by law, MINK is not liable for indirect or incidental damages.
11. Force majeure
MINK is not liable for delays and service interruptions caused by events beyond its control (natural disasters, communication outages, government measures, etc.).
12. Governing law and disputes
These Terms are governed by the legislation of the Republic of Azerbaijan. Disputes are resolved first through negotiation and, failing agreement, in the courts of the city of Baku.
13. Changes
MINK may update these Terms. Use of the Platform after a change constitutes acceptance of the updated Terms. Significant changes may be communicated within the app.
